

Terms and Conditions (T&C)
1. Scope
These General Terms and Conditions (T&C) apply to all appointments booked via the online appointment calendar of Smartpraxis Dr. Sirfy, both for self-pay services (private services) and for other appointments.
2. Conclusion of Contract
(1) By booking an appointment, the patient makes a binding offer to enter into a treatment contract.
(2) The contract is concluded once the practice confirms the appointment.
(3) The terms displayed during the booking process shall apply.
A. Appointments Requiring a Deposit (e.g. check-ups, self-pay services)
3. Deposit
(1) A deposit by credit card or Apple Pay is required for certain appointments.
(2) The deposit serves solely to reserve the appointment and to secure it organisationally.
(3) The deposit will be credited against the subsequent invoice in accordance with the GOÄ (German Medical Fee Schedule).
(4) Any differences will be settled or refunded after the treatment.
4. Appointment Commitment
These appointments are reserved exclusively for the patient.
5. Cancellation of Appointments with a Deposit
Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time.
6. Cancellation Fee (Appointments with a Deposit)
(1) In the event of cancellation less than 24 hours before the appointment, or if the patient fails to attend, the practice may retain all or part of the deposit as a cancellation fee, provided the appointment could not be reassigned and a loss has actually been incurred.
(2) The cancellation fee is based on the actual loss incurred, taking into account any expenses saved.
(3) In this case, any credit already granted may be offset in whole or in part against the cancellation fee.
B. Other Appointments
7. Appointment Commitment
These appointments are also binding and are allocated exclusively.
8. Cancellation (Other Appointments)
The applicable cancellation periods are displayed during the booking process.
9. Cancellation Fee (Appointments Not Requiring Payment)
(1) If the patient fails to attend or cancels late, a reasonable cancellation fee may be charged, provided the appointment could not be reassigned.
(2) The amount is based on the loss incurred and generally amounts to up to €150.
(3) Expenses saved will be taken into account.
(4) The patient reserves the right to prove that no loss or a significantly lower loss was incurred.
C. General Provisions
10. Legal Basis
These provisions are based on Section 615 of the German Civil Code (BGB) (default of acceptance).
11. Proof of Lower Loss
The patient reserves the right to prove that no loss or a lower loss was incurred.
12. Refunds
Refunds are made via the original payment method.
13. Appointment Changes by the Practice
No costs are incurred if the practice cancels the appointment.
14. Final Provisions
(1) German law applies.
(2) Should individual clauses be invalid, the remaining provisions shall remain valid.
